Please also refer to the Acceptable Use Policy inside our Terms and Conditions, available at https://www.thrivemobile.com/policy/terms-conditions. In some cases, our Services may have links to websites operated by third parties, plugins for social media services, or third-party advertisements.

When you interact with third-party services, you may be consenting to those third parties accessing, collecting, using, or disclosing your Personal Information through our Services or directing us to share or allow access to your Personal Information by those third parties, such as your IP address, browsing activity, or location information. Those services operate independently of our Services, and your Personal Information will be governed by their terms and conditions, including their privacy policies, not this Privacy Policy. We encourage you to review the privacy policies of any third-party services that you use to better understand their privacy practices. You may be able to restrict or disable the use and disclosure of certain information, such as your location information, using settings available on your Device or through the third-party services.

Your Rights and Our Obligations Related to Your Customer Proprietary Network Information

Customer Proprietary Network Information (CPNI) is information made available to us solely by virtue of our relationship with you that relates to the type, quantity, destination, technical configuration, geolocation data, and amount of use of the telecommunications services you purchase from us, as well as information related to the billing for those services.

CPNI does not include subscriber list information such as name, postal address, or telephone number. Under federal law, you have the right, and we have the duty, to protect the confidentiality of your CPNI. When we share your CPNI with our service providers or contractors, we require them to take reasonable measures to protect the confidentiality of that information.

We are permitted to use or disclose your CPNI for certain purposes without further notice or consent from you, including: to provide you with our Services; to market service offerings to you related to the services you purchase; to protect us, you, other subscribers, and other carriers from fraud, abuse, or unlawful use of the Services; and in an aggregate form. We also may use your CPNI, or share it with affiliates and third-party agents, for the purpose of offering you communications-related products and services, packages, discounts, and promotions that may be different from the types of services you have already purchased.

You have the right to opt out of use of your CPNI for marketing purposes and can submit an opt-out request by contacting us at thrivemobile.com/contact or (888) 445-1069. Opting out will not affect our provision of Services to you or our use of your CPNI for permitted purposes. If you choose to opt-out, your choice is valid until you choose to opt in. You may also contact us to correct your CPNI or request that we disclose your CPNI to you.

We will not disclose your CPNI except when provided with your password, and we may implement other authentication measures. If you do not provide a password, we may not release your CPNI to you except by sending it to your address of record or by calling you at your telephone number of record. Be sure to use a strong password with our Services and not one you use for other services. We may disclose your CPNI to any “authorized user” that you have designated to us in writing or to any person who is able to provide us with your password.

Thrive Mobile will honor STOP and opt-out requests for any communications we send directly, or on behalf of a client partner using our systems.

Revoking consent to marketing communications will not affect your receipt of required service-related communications.

California Consumer Privacy Act

This section provides additional information for California residents under the California Consumer Privacy Act (“CCPA”) and any effective amendments thereto. The terms used in this section have the same meaning as those used in CCPA. This section does not apply to information that is not considered “Personal Information” under CCPA such as anonymous, deidentified, aggregated, or public information. The CCPA defines these terms as:

“Aggregate consumer information” means information that relates to a group or category of consumers, from which individual consumer identities have been removed, that is not linked or reasonably linkable to any consumer or household, including via a device. “Aggregate consumer information” does not mean one or more individual consumer records that have been deidentified.

“Deidentified” means information that cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular consumer, provided that a business that uses deidentified information:

(1) Has implemented technical safeguards that prohibit reidentification of the consumer to whom the information may pertain.

(2) Has implemented business processes that specifically prohibit reidentification of the information.

(3) Has implemented business processes to prevent inadvertent release of deidentified information.

(4) Makes no attempt to reidentify the information

“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information includes, but is not limited to, the following:

(A) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

(B) Any categories of personal information described in subdivision (e) of Section 1798.80, i.e., including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. “Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

(C) Characteristics of protected classifications under California or federal law. California protected classifications include race; color; religion (includes religious dress and grooming practices); sex/gender (includes pregnancy, childbirth, breastfeeding and/ or related medical conditions); gender identity/expression; sexual orientation; marital status; medical condition; military or veteran status; national origin; ancestry; disability (mental and physical including HIV/AIDS, cancer, and genetic characteristics); genetic information; request for family care leave; request for leave for an employee’s own serious health condition; request for pregnancy disability leave; retaliation for reporting patient abuse in tax-supported institutions; age (over 40).

(D) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

(E) Biometric information.

(F) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an Internet Web site, application, or advertisement.

(G) Geolocation data.

(H) Audio, electronic, visual, thermal, olfactory, or similar information.

(I) Professional or employment-related information.

(J) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99).

(K) Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

(L) On-device engagement including all clicks / taps within our Thrive Mobile application including aspects of Get Help, launching activities, snoozing, starting activities, and account modifications to inform our program’s effectiveness, engagement rates and identify improvement opportunities for our experience. These analytics will be stored and analyzed in third party tools such as Amplitude for reporting purposes.

“Personal information” does not include publicly available information. For these purposes, “publicly available” means information that is lawfully made available from federal, state, or local government records, if any conditions associated with such information. “Publicly available” does not mean biometric information collected by a business about a consumer without the consumer’s knowledge. Information is not “publicly available” if that data is used for a purpose that is not compatible with the purpose for which the data is maintained and made available in the government records or for which it is publicly maintained. “Publicly available” does not include consumer information that is deidentified or aggregate consumer information.

“Sell,” “selling,” “sale,” or “sold,” means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to another business or a third party for monetary or other valuable consideration.

The CCPA states that a business does not sell personal information when:

(A) A consumer uses or directs the business to intentionally disclose personal information or uses the business to intentionally interact with a third party, provided the third party does not also sell the personal information, unless that disclosure would be consistent with the provisions of this title. An intentional interaction occurs when the consumer intends to interact with the third party, via one or more deliberate interactions. Hovering over, muting, pausing, or closing a given piece of content does not constitute a consumer’s intent to interact with a third party. (B) The business uses or shares an identifier for a consumer who has opted out of the sale of the consumer’s personal information for the purposes of alerting third parties that the consumer has opted out of the sale of the consumer’s personal information. (C) The business uses or shares with a service provider personal information of a consumer that is necessary to perform a business purpose if both of the following conditions are met: services that the service provider performs on the business’ behalf, provided that the service provider also does not sell the personal information. (i) The business has provided notice that information being used or shared in its terms and conditions consistent with California Civil Code Section 1798.135. (ii) The service provider does not further collect, sell, or use the personal information of the consumer except as necessary to perform the business purpose.

Additional State Privacy Rights and Notices

Residents of All States — Your Rights

Regardless of where you live, and in addition to any rights described in the state-specific sections above, you may exercise each of the following rights with respect to the Personal Information we hold about you:

  • Confirm whether we are processing your Personal Information, and access that information;
  • Correct inaccuracies in your Personal Information, taking into account the nature of the information and the purposes of processing;
  • Request that we delete Personal Information you provided or that we obtained about you, unless retention is required by law;
  • Obtain a copy of your Personal Information in a portable and, to the extent technically feasible, readily usable format;
  • Obtain a list of the categories of third parties to which we have disclosed your Personal Information; and
  • Opt out of the processing of your Personal Information for purposes of targeted advertising, the sale of Personal Information, or profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning you.

We do not sell your Personal Information, and we do not use it for targeted advertising or for profiling in furtherance of decisions that produce legal or similarly significant effects.

How to exercise these rights. Contact us at help@thrivemobile.com or (888) 445-1069. We will not require you to create a new account in order to exercise a right, though we may ask you to use an existing account. We will respond within 45 days of receipt. If we need additional time, we may extend that period by an additional 45 days where reasonably necessary based on the complexity and number of your requests, and we will tell you of the extension and the reason for it within the original 45-day period.

Appeals. If we decline to act on your request, we will tell you without undue delay, and no later than 45 days after receiving it, why we declined, and we will provide instructions for how to appeal. We will inform you in writing of any action taken or not taken in response to your appeal, together with a written explanation of our reasons, no later than 60 days after receiving the appeal. If we deny your appeal, we will provide you with a mechanism to submit a complaint to your state's enforcement authority.

Authorized agents. You may designate another person to act as your authorized agent to opt out of processing on your behalf, including through an internet link, a browser setting or extension, a global device setting, or similar technology indicating your intent to opt out. We will comply with an opt-out request from an authorized agent where, using commercially reasonable efforts, we can authenticate your identity and the agent's authority to act for you.

Opt-out preference signals. You may opt out of any processing of your Personal Information for purposes of targeted advertising or any sale of Personal Information through an opt-out preference signal sent, with your consent, by a platform, technology, or mechanism indicating that intent. We honor opt-out preference signals recognized by the states that maintain lists of approved mechanisms.

Withdrawing consent. Where we rely on your consent, you may withdraw it at any time through a mechanism at least as easy as the one by which you provided it, and we will stop the affected processing as soon as practicable and no later than 30 days after we receive your request.

Non-discrimination. We will not discriminate against you for exercising any of these rights, including by denying goods or services, charging different prices or rates, or providing a different level or quality of goods or services.

Sensitive Information and Consumer Health Information

We treat the following as sensitive information: health and clinical information, including information used to identify your physical or mental health status; genetic and biometric data; racial or ethnic origin; religious beliefs; sex life, sexual orientation, and status as transgender or nonbinary; national origin; citizenship or immigration status; precise geolocation data; and the personal information of a child.

We obtain your consent before processing sensitive information. We request that consent separately from our Terms and Conditions and from any other agreement. Consent to one purpose is not consent to another, and we do not treat acceptance of general terms and conditions, silence, inactivity, pre-ticked boxes, or your failure to opt out as consent. When we request consent, we will tell you who we are, why consent is required, the purposes for which we are seeking it, the categories of information involved, and how to withdraw it.

We do not sell sensitive information.

Limits on our collection and use. We limit our collection of Personal Information to what is reasonably necessary and proportionate to provide or maintain the products and services you request. We do not process Personal Information for any purpose that is neither reasonably necessary to, nor compatible with, the purposes disclosed to you, unless we obtain your consent. We maintain reasonable administrative, technical, and physical safeguards appropriate to the volume and nature of the information we hold.

Illinois and Texas Residents — Biometric Information

This section applies in addition to the Facial Biometric Information disclosures above.

Notice and written release. Before we, or our identity-verification provider on our behalf, collect, capture, or otherwise obtain a scan of your face geometry or a voiceprint, we will inform you in writing that biometric identifiers or biometric information are being collected or stored, inform you in writing of the specific purpose and the length of term for which they are being collected, stored, and used, and obtain your written release.

Retention and destruction. We maintain a written policy establishing a retention schedule and guidelines for permanently destroying biometric identifiers and biometric information. Your facial image and government-issued identification document are collected and retained by our identity-verification provider under that schedule, which provides for permanent destruction no later than one year after the purpose for collection has been satisfied. Thrive Mobile does not retain your facial image; we receive only confirmation that your identity was verified.

No sale or disclosure. We do not sell, lease, trade, or otherwise profit from your biometric identifiers or biometric information. We do not disclose them except with your consent, to complete a financial transaction you requested and authorized, as required by law, or in response to a valid warrant or subpoena.

Safeguards. We protect biometric identifiers and biometric information from disclosure using reasonable care, and in a manner at least as protective as that in which we store, transmit, and protect other confidential and sensitive information.

Washington Residents — Consumer Health Data

If you are a Washington resident, or if your consumer health data is collected in Washington, this section applies to consumer health data that is not otherwise exempt under Washington law. Consumer health data includes personal information linked or reasonably linkable to you that identifies your past, present, or future physical or mental health status, including biometric data, genetic data, precise location information that could reasonably indicate an attempt to receive health services or supplies, data identifying you as seeking health care services, and inferences or derived data used to associate or identify you with health-related information.

We maintain a consumer health data privacy policy that discloses the categories of consumer health data we collect, the purposes for which we collect and use it, the categories of sources from which we collect it, the categories of consumer health data we share, the categories of third parties and specific affiliates with whom we share it, and how you may exercise your rights. We prominently publish a link to that consumer health data privacy policy on our homepage, and, where applicable, on the app store or download page for our mobile application and within the application.

We collect consumer health data only with your consent for a specified purpose or to the extent necessary to provide a product or service you requested, and we share consumer health data only with separate consent for sharing or to the extent necessary to provide a product or service you requested. We do not collect, use, or share additional categories of consumer health data, or use or share consumer health data for additional purposes, unless we first disclose the additional categories or purposes and obtain your affirmative consent.

We do not sell consumer health data. If we ever sell or offer to sell consumer health data, we will first obtain a separate signed authorization that is written in plain language, expires one year after signature, and contains the information required by Washington law.

You may confirm whether we collect, share, or sell your consumer health data; access that data, including a list of third parties and affiliates with whom it has been shared or sold; withdraw consent; and request deletion. If you request deletion, we will delete consumer health data from our records and notify affiliates, processors, contractors, and other third parties with whom we shared the data so they can honor the deletion request as required by law. We will respond to consumer health data requests without undue delay and in all cases within 45 days, subject to one 45-day extension when reasonably necessary, and appeals will be answered within 45 days.

Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia Residents

If you reside in a state with a comprehensive consumer data privacy law, you have the rights described under "Residents of All States — Your Rights" above, and the sensitive-information protections described above apply to you. We do not provide a separate section for each state; this Privacy Policy is written to meet the requirements of each such law, and residents of these states are entitled to the rights their state law provides.

This section is intended to provide a unified notice for residents of these states and should be read together with any more specific state or data-type section above, including the sections for biometric information, Washington consumer health data, California, Nevada, and Virginia.

Where This Policy Is Available

This Privacy Policy is available through a conspicuous link on our website homepage, on the app store or download page for the Thrive Mobile application, and in the application's settings menu.

Our Assessments

Where we process sensitive information or engage in profiling, we conduct and document an assessment of that processing, including the categories of information involved, the context and purposes of the processing, the risks to you, the safeguards we apply, and our balancing of the benefits against those risks.

Interaction With HIPAA

Some of the information described in this Privacy Policy is protected health information governed by the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations. Where a state privacy law relating to the privacy of individually identifiable health information imposes requirements more stringent than HIPAA, we comply with the more stringent requirement. Nothing in this section limits any right you have under HIPAA, including your right to receive an accounting of certain disclosures or to revoke an authorization you have given us.

Collection and Disclosure of Personal Information

Personal Information Notices. For purposes of compliance with the CCPA, in addition to other details described in this Privacy Policy, we provide the following notices:

  • We collect the following categories of Personal Information as described in the Types of Personal Information We Collect About You and Sources of Personal Information We Collect About You sections above.
  • We disclose the following categories of Personal Information for a business purpose as described above in How We Use Personal Information We Collect About You and How We Share or Allow Access to Your Personal Information.

Retention of Personal Information

We retain Personal Information only for as long as reasonably necessary to provide our services, fulfill the purposes described in this Policy, comply with legal and contractual requirements, resolve disputes, prevent fraud, maintain security, and enforce our agreements. In determining an appropriate retention period, we consider the nature and sensitivity of the information, the purposes for which it was collected, applicable legal and contractual requirements, and whether those purposes can be achieved through deletion, aggregation, or de-identification.

Unless a different period described below applies, we retain account, service, and usage information for the life of the account and for up to ten (10) years after account termination or the individual’s last interaction with the applicable service. We may retain particular records for a shorter period where they are no longer reasonably necessary.

  • Health and clinical information retrieved at your direction. If you authorize us to retrieve health or clinical information through HealthEx or another service, we retain that information while your authorization remains effective and for as long as reasonably necessary to provide the services you requested. If you withdraw your authorization or terminate your account, we stop retrieving new information and stop using previously retrieved information to provide the discontinued service. We delete or de-identify previously retrieved information within 10 years, unless continued retention is required by law, an applicable health-plan agreement, a documented legal hold, or another purpose disclosed in this Policy. Limited copies may remain temporarily in encrypted backups until those backups are overwritten or securely deleted in accordance with our backup-retention schedule. HealthEx’s handling of information within its own services is described in its Terms of Service (https://www.healthex.io/terms-of-service) and Privacy Policy (https://www.healthex.io/privacy-policy).
  • Health-plan program information. If you are or were eligible for a program offered through a health plan, we may receive eligibility, claims, utilization, and quality-measure information from that health plan. This may include information concerning individuals who were eligible but did not enroll and former program participants. We use this information to administer the program, measure and report program performance and outcomes, satisfy audit and regulatory requirements, and, where permitted, create derived information used to improve or personalize the member experience. Raw health-plan information is maintained separately from the member profile and is not used directly for personalization. We retain records subject to Medicare Advantage, other CMS-program, or health-plan contractual requirements for ten (10) years from the individual’s opt-out, deactivation, contract termination & specified data destruction or removal date or longer where an applicable contract, audit, investigation, dispute, or legal hold requires it.
  • Identity-verification information. Our identity-verification provider, Clear, may collect a facial image, an image of a government-issued identification document, and related identity-verification information. The provider retains and deletes that information according to their Terms of Use (https://www.clearme.com/terms-of-use) & Privacy Policy (https://www.clearme.com/privacy-policy), as well as our contractual instructions. Thrive Mobile does not retain the facial image or copy of the identification document. We retain the verification result and related transaction or audit information for 10 years for account-security, fraud-prevention, compliance, and dispute-resolution purposes.
  • Records subject to legal or contractual requirements. We retain particular records for the period required by applicable law or contract. HIPAA requires certain policies, procedures, authorizations, assessments, and other required documentation to be retained for at least six (6) years from creation or from the date the documentation was last effective, whichever is later. HIPAA does not establish a universal six-year retention period for all health information. Other health information may be retained for a different period under applicable state law, CMS requirements, a health-plan agreement, or another legal or contractual obligation. Where multiple requirements apply, we use the longest period legally or contractually required for the particular record.
  • Emergency-call records. When you call 911, our underlying network carrier transmits your device's location to emergency responders so they can locate you. Records of calls placed to 911 are maintained as part of our call detail records and are retained for ten years, consistent with the retention schedule described above. Emergency-call location information, such as positioning method and geolocation data, is generated and maintained by our underlying network carrier rather than by Thrive, and requests for that information should be directed to the carrier.
  • Deletion requests. If you exercise a deletion right available under applicable law, we delete the information covered by the request unless an applicable exception permits or requires continued retention. When an exception applies, we retain only the information reasonably necessary for that exception and do not use it for unrelated purposes.
  • Backups and legal holds. Information scheduled for deletion may remain for a limited period in encrypted backups or disaster-recovery systems and will be deleted or rendered inaccessible through our ordinary backup-rotation process. We may suspend scheduled deletion when information is subject to a legal hold, audit, investigation, security incident, dispute, or other preservation obligation.

The retention periods above apply according to the category and purpose of the information. When information is subject to more than one category, we apply the period that is legally or contractually required for that information and purpose.

Purpose of Collection

As explained above in How We Use Personal Information We Collect About You and How We Share or Allow Access to Your Personal Information, we also collect your Personal Information for the following business or other notified purposes:

  • Auditing relating to a current interaction with you, including but not limited to counting ad impressions, verifying positioning and quality of ad impressions, and compliance.
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • Debugging to identify and repair errors that impair existing intended functionality.

  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

We note that under the CCPA, use of your Personal Information for these purposes is not subject to consumer’s Right to Delete, as described below and under California law.

We may also deny a request for deletion if it is necessary for us or a service provider or contractor to maintain your Personal Information in order to:

Such requests will still undergo a verification process, and we will deny requests from agents who do not submit proof of authorization from you. To exercise these rights, you may contact us at help@thrivemobile.com or (888) 445-1069.

Right to Opt Out

To the extent applicable, Virginia residents also have the right to opt out of the processing of Personal Data for purposes of targeted advertising, the sale of Personal Data, or profiling in furtherance of decisions that produce legal or similarly significant effects.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for exercising any of your privacy rights. We will not discriminate against you for exercising any of your rights under this section, including, but not limited to:

  • Denying goods or services.
  • Charging different prices or rates for goods and services.
  • Providing a different level or quality of goods or services.

We may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided by your data and/or your voluntary participation in a bona fide loyalty, rewards, premium features, discounts, or club card program.

Verification and Response Process

If you submit a request to access, correct, or delete Personal Data, we will need to verify your identity and confirm your request before processing it. When you make such a request, you can expect the following:

  • We will verify your identity. You will need to provide us with your email address and full name. We may ask for additional information if needed.
  • We will confirm that you want your information accessed, corrected, and/or deleted.
  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the email or phone number listed above.
  • We will respond to your request within 45 days. If we need additional time to respond, we will notify you within the original 45 days, and provide a final response within 45 days thereafter. If we need an extension, we will explain why.
  • In certain cases, a request for access, correction, or deletion may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. If we deny your request, we will explain why we denied it. If there is a portion of your request that we can comply with, for example deleting some of the requested information, then we will do so.

Consumer Request Appeal Process

To the extent appliable, if we deny your request to access, correct, or delete Personal Data, you have the right to appeal that decision using the following process:

  • Contact us in the same manner you submitted your original request with the subject line: “Appeal—Virginia Privacy Request.”
  • Within 60 days of receipt of your appeal, we will respond and inform you in writing of any action taken or not taken, including a written explanation of the reasons for our decision.
  • If we deny your appeal, you may contact the Virginia Attorney General to submit a complaint here: https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.
